Canada Immigration Services - Temporary Status

Individuals can apply for temporary status to visit, study or work in Canada.

In order to obtain a work permit, the principal applicant must have received a job offer to work in Canada. Selecting the correct work permit law and processing strategy is key to success. The immigration regulations and policies thereto have over 500 different work permit and non-immigrant categories and subcategories. Choosing the best option, in your particular case, is critical to obtaining entry.

-Visitor Visas

Canadian Visitor Visas are issued to tourist or business visits to Canada where the foreign worker will not enter or participate in the Canadian labour market. Certain individuals can work on a visitor visa, such as members of the clergy, emergency repair personnel, news reporters, guest speakers, and so forth based on meeting certain visitor visa conditions.

-Student Permits

Persons seeking to study full time in Canada must demonstrate that they have an offer of acceptance to a full time program at a recognized educational institution, as well as the financial resources to support themselves full and the intention to depart after their studies are completed. Students may be eligible to work on campus without a work permit.

-LMO Work Permits

A job offer from a Canadian employer is required in order to obtain a LMO (Labour Market Opinion) Work Permit. These work permits involve a bifurcate application process: 1) A Labour Market Opinion application through Service Canada and 2) A Work permit application to the correct processing post (which varies according to circumstance) once the LMO is issued.

-NAFTA, GATS and CAFTA Work Permits

These are international treaty work permits designed to facilitate the intra-national transfer of citizens of the signing countries. Citizens of US, Mexico and Chile qualify for simplified work permit procedures under certain subcategories. All of the above agreements incorporate facilitated entry of professionals and intra-company transferees.

-Intra-Company Work Permits

Companies that have branches, subsidiaries or affiliates in Canada, where the ownership relationship is over 50% with the Canadian entity, may obtain work permits for executives, senior managers or specialized knowledge professionals in their corporation provided that one year of employment can be demonstrated within the past three years, and subject to other conditions.

-Live in Caregiver Program

Live in Caregivers, with secondary education and experience may apply to provide live in care in private households in Canada for children, the elderly or the disabled. Applicants must demonstrate successfully completed education equivalent to a Canadian secondary education as well as six months of training or twelve months' experience in care giving. English communication ability is required. Live in caregivers are normally admitted for an initial two year period which they can renew once in Canada and after successfully completing two full time years of live in care giving in Canada, they may apply for permanent residence.

-Temporary Resident Permits

When individuals are not admissible to Canada for medical or criminal reasons, their inadmissibility may be overcome by the issuance of a temporary resident permit (TRP). TRP's enable essential skills workers, with a criminal record, for example, to enter Canada provided that they can demonstrate that they will not endanger Canadian health or safety.
